Houston criminal trial attorney Jim Sullivan represented his client on the serious 3rd degree felony charge of Indecency with a Child by Exposure charges.  He was the second defense attorney to represent him on the same accusations.  His client was previously represented by a different attorney who managed to get his indictment for Indecency with a Child by Contact quashed.  When the DA’s office re-indicted the case as Indecency with a Child by Exposure, Sullivan went to work and persuaded his client who maintained his innocence to go to trial.  His client was willing to take probation, but Sullivan does not believe that a person should plead guilty when they are not guilty.  Sullivan’s client was borderline mentally challenged with a low IQ, however he had a clear understanding of the allegations in the case.  The client’s older brother assisted him in coming to and from court and in helping Sullivan to track down and interview witnesses.  Sullivan thoroughly investigated the case and learned that the child’s father had huge motives to falsify the charges.  In fact, by the time of trial, he had already pled guilty to fraud charges in a different county and was on a felony probation.  The man had a bad drug addiction and had stolen money from his deceased wife’s estate to live it up with a new young girlfriend.  The wife had left the money for her daughter from a prior marriage.  There was much more exculpatory information that Sullivan had uncovered through his investigation.  Ultimately, on the date of trial, the State dismissed the charges against his client.
